HONDURAS PROPERTY TAX GUIDE

Start with the municipality, the title and the legal owner

This Honduras property tax guide covers municipal real estate tax, acquisition costs, rental income, capital gains, coastal ownership structures and title security.

A home in Tegucigalpa, a commercial rental in San Pedro Sula and a Roatán coastal property can require different checks. Build the budget around the municipality, registered parcel, owner’s tax status and intended use. Amounts shown in lempiras use L. or HNL.

Important: foreign ownership near coastlines, borders and on islands needs a parcel-specific legal review. Article 107 sets restrictions, while Decreto 90-90 provides a special route for qualifying urban property. Creating a Honduran company alone is not proof that a purchase qualifies. KEY FIGURES · CHECK THE TAX BASE

1.5%

SAR’s general property-transfer tax reference. Confirm the taxable value, exemptions and payment responsibility.

10%

General capital-gains reference on the taxable gain, separate from transfer tax and closing charges.

0.35%

Urban municipal property-tax ceiling equivalent to L.3.50 per L.1,000. The municipality sets the applicable rate.

40 km

Coastal and border restriction zone under Article 107; islands also require ownership-eligibility review.

01 · MUNICIPAL REAL ESTATE TAX

Confirm the assessment for the actual parcel

The municipal Impuesto sobre Bienes Inmuebles is annual. Article 76 sets ceilings of L.3.50 per L.1,000 of urban value (0.35%) and L.2.50 per L.1,000 of rural value (0.25%). The municipality fixes the applicable rate; the ceiling is not every property’s bill.

Parcel → cadastral value → municipal rate → account balance

Request the current assessment, land and building details, applicable rate, payment ledger and arrears. Example: an accepted taxable urban value of L.2,000,000 at 0.35% gives L.7,000 before relief or other charges.

Article 76 places payment in August and provides a 2% monthly late surcharge. Confirm the municipality’s current calendar and any legally authorised relief. Service charges and improvement contributions need separate budget lines. Municipalities Law, Article 76

02 · VALUATION & EXEMPTIONS

Separate assessed value from the asking price

The municipal calculation uses cadastral value, or declared value when no cadastral value exists. Check recorded use, location and improvements. A purchase price does not automatically replace the municipal assessment.

Owner-occupied housing has partial exemptions tied to municipal population bands. Ask the municipality for the applicable relief and proof required; do not assume a rental or company-owned building qualifies. Assessment and exemptions

03 · TITLE & CADASTRE

Match the registered title to the land on the ground

Identify the folio real, registered owner, cadastral reference and exact property being sold. SINAP provides property-administration and registry consultation tools, including presentations, registration images and certifications.

Obtain the current records and reconcile them with an independent survey, legal access and physical boundaries. A cadastral entry, tax payment or occupation of land does not by itself establish clean title. Official SINAP consultations

04 · TRANSFER TAX

Budget the tradition tax before signing

SAR’s July 2026 guide gives a 1.5% transfer-tax reference for an onerous property transfer. It states that the base is the higher of market value and cadastral value; when there is no cadastral value, declared value applies.

The guide places payment on the transferor within the third day after authorisation of the original deed. Contractual cost allocation should be agreed without assuming it changes the statutory taxpayer. Have the notary confirm exemptions and the applicable instrument.

Illustration: a confirmed taxable base of L.2,000,000 × 1.5% = L.30,000. This excludes capital-gains tax and other closing costs. SAR transfer-tax guide, Code 152

Identify the instrument

Identify a sale, gift, inheritance, company transfer or other instrument before pricing the closing.

Confirm the valuation

Confirm market and cadastral values and the base accepted for each separate charge.

Keep the completion file

Keep the deed, tax receipt, registry presentation and evidence of completed registration.

05 · REGISTRY & NOTARY COSTS

Request a complete closing statement

The IP’s published sale-registration requirements identify a L.200 base charge and L.1.50 per additional L.1,000 or fraction under the stated schedule. Confirm the current payable amount and treatment of your deed with IP; do not add a blanket percentage mechanically.

Request an itemised quote for registration, certified records, notary work, survey, valuation, mortgage cancellation and approvals. Distinguish statutory charges from professional fees and check any applicable exemption. IP sale-registration requirements

06 · RESIDENTIAL RENTAL INCOME

Check the special residential-rental tax

SAR describes a special annual, final 10% tax for natural persons on qualifying residential rent above L.15,000 per month, including the combined rent from units or rooms within the same property.

Hotels, motels and lodging businesses are excluded from that special regime and follow income-tax treatment. Confirm whether the owner and activity qualify, rather than applying 10% to every rental. SAR residential-rental guidance

Keep leases, a monthly rent ledger, deposits, invoices and evidence of repairs. Ask an accountant how other rental income, company ownership and filing obligations are treated. Income-tax resources

07 · NONRESIDENT RENTAL INCOME

Agree who withholds before rent is remitted

SAR’s Article 5 guidance lists a 25% reference for income from movable or immovable property paid to nonresident or nondomiciled persons, subject to the categories and exceptions in that provision.

Confirm how tax residence, operating structure and any applicable special rule affect your rental. Agree who deducts, declares, pays and supplies withholding evidence before remitting proceeds abroad. SAR nonresident-income table

08 · COMMERCIAL & SHORT-STAY RENTALS

Classify the rental activity before setting the price

Residential occupation, a commercial lease and tourist accommodation need separate classification. SAR’s guidance identifies residential rental among sales-tax exemptions and refers to relief for commercial premises whose rent does not exceed L.5,000.

Have an accountant confirm the current exemption, taxable supply, registration and invoicing rules for the actual arrangement. Short stays and bundled services also need an operating-permit and tourism review; residential-rent wording does not establish an exemption for a lodging business. 09 · CAPITAL GAINS

Calculate tax on the documented gain

SAR gives a general 10% capital-gains rate for natural or legal persons, whether domiciled in Honduras or not. The calculation concerns a taxable gain, not a universal 10% charge on the entire selling price.

Illustration only: L.3,000,000 proceeds less an accepted L.2,200,000 cost base produce L.800,000; at 10%, tax is L.80,000 before any further permitted adjustments. Confirm the allowable basis and classification of a property-trading business. SAR capital-gains guidance

10 · SALE TAXES & RECORDS

Keep transfer tax separate from capital gains

A sale can create both transfer-tax and capital-gains obligations. Calculate each separately and confirm whether buyer withholding or another payment mechanism applies to the seller’s status.

Keep the acquisition deed, purchase payments, improvement invoices, valuations and disposal-cost records. Ask for the current form, deadline and evidence needed to claim any relief. Do not assume an owner-occupied property or long holding period creates an automatic exemption. Capital-gains tax reference · Transfer-tax filing guidance

11 · TITLE SECURITY

Verify the seller, encumbrances and boundaries

Obtain current registered-title and encumbrance records, including a constancia de libertad de gravamen where appropriate. Check mortgages, attachments, easements, pending presentations and the complete ownership chain.

Verify identity, marital or estate authority, company powers and any power of attorney. Reconcile municipal arrears, survey boundaries, legal access and occupation. An independent Honduran attorney should confirm whether the transaction can be registered and how completion protects the buyer. Registry consultations and certifications

12 · COASTAL OWNERSHIP STRUCTURES

Check Article 107 and the urban-property route

Article 107 restricts acquisition or holding by foreigners in the coastal and border belt extending 40 km inland and on islands and related features. Its general company rule requires entirely Honduran ownership; a locally registered company is not an automatic workaround.

Decreto 90-90 provides a route for qualifying urban property. Article 5 describes a personal residential route with a 3,000 m² limit and ordinarily one property; qualifying vacant land has a 36-month building condition. Article 4 addresses approved projects.

Before choosing personal or corporate ownership, obtain written confirmation of the parcel’s urban or tourism status, applicable route, approvals and ongoing obligations. Article 107 · Decreto 90-90

13 · OWNERSHIP BUDGET

Allow for recurring costs and reserves

Separate acquisition charges from annual municipal tax, insurance, maintenance, utilities, security, management and shared-development fees. Allow for vacancy, major repairs and currency movements before comparing net yields.

For coastal property, inspect storm exposure, drainage, shoreline conditions, access and availability of insurance. Obtain association budgets, reserves and rental restrictions where applicable. These are practical budgeting checks, not a uniform national property levy.

14 · REMOTE OWNERS & MANAGEMENT

Keep the ownership and reporting file current

Put rent collection, repair authority, payment limits and monthly reporting into the management agreement. Require rent-ledger reconciliations, bank statements, invoices and tax receipts.

Keep RTN and tax registrations, company records where relevant, title records and any coastal approvals current. Coordinate Honduran reporting with obligations in the owner’s residence country. Ownership, immigration status and permission to operate a business are separate questions.

15 · TRANSACTION CHECKLIST

Make the next step depend on verified documents

Before an offer

Verify title, survey, access, municipal account and foreign-buyer eligibility for the specific parcel.

Before completion

Approve the itemised costs, clear arrears and encumbrances, and confirm the registry completion process.

Before collecting rent

Confirm rental classification, owner’s tax status, withholding, invoicing and operating permissions.

Before a sale

Document cost basis, sale proceeds, transfer tax, capital-gains reporting and any required withholding.

RESEARCH STANDARDS

Reviewed 2 October 2026. References come from SAR, IP/SINAP and official legislation. Municipal assessments and coastal eligibility require local confirmation for the specific owner and property.

This guide provides general information and is not individual legal, tax, financial, appraisal or brokerage advice. It does not create an agency relationship. A Honduran attorney, accountant and qualified surveyor should verify the title, values, taxes, exemptions and approvals before a transaction. Services, licensing and availability depend on jurisdiction and agreement.

Compare other property tax guides

Comparing countries can help you identify questions to ask about annual property tax, purchase charges, rental income and capital gains. The guides below cover different tax systems; compare their categories and verification steps before comparing headline rates.

Build a separate worksheet for each proposed property. Note the municipality, registered owner, intended use, acquisition date and currency. Beside every amount, record whether it is an official assessment, a professional estimate or an item still awaiting confirmation. A quoted purchase price alone does not establish the taxable value or the complete cost of ownership.

When comparing a property in Honduras with one elsewhere, separate recurring taxes from one-time transaction charges and private operating costs. Confirm who pays each amount, when it falls due and which document proves payment. Keep exemption applications, tax receipts and title records in the same property file so your advisers can trace the assumptions behind the budget.
