Check the tax classification before setting your budget
This Panama property tax guide covers annual property tax, transfer tax, capital-gains withholding, rental income, exemptions, horizontal-property costs and residency incentives.
A Panama City apartment, a Boquete home and a coastal rental can have different tax and operating requirements. Start with the registered finca, cadastral value, approved exemptions, ownership structure and intended use. Amounts shown as B/. are balboas; US dollars circulate at the same nominal value.
Important: the Qualified Investor framework changed in September 2026. Decree 17 distinguishes new first-sale property from secondary-market property. Verify the applicable category before relying on older summaries or an advertised investment threshold. Current official decree

Use the correct Panama property tax schedule
For approved Patrimonio Familiar Tributario or Vivienda Principal, the combined progressive schedule exempts the first B/.120,000, applies 0.5% to the portion above B/.120,000 through B/.700,000 and 0.7% to the excess above B/.700,000. Law 66 property-tax framework
The general schedule for other residences, commercial property, industrial property and land exempts the first B/.30,000; the next portion through B/.250,000 pays 0.6%, the portion through B/.500,000 pays 0.8%, and the excess pays 1%. Rates apply progressively, rather than one rate to the entire value.
These are cadastral-value schedules. Obtain the DGI account and evidence of the actual classification, land value, declared improvements and exemptions. Special regimes can change the result, particularly PH units with exempt improvements.
Confirm approval, scope and expiry of every benefit
Patrimonio Familiar Tributario and Vivienda Principal are defined benefits for qualifying permanent residential use. Apply through DGI and verify approval; a seller calling the property a primary residence does not establish your eligibility. DGI home-status procedures
Ask for the exemption resolution, start and end dates, covered improvements and treatment of the land. A construction exemption, special exemption and home-status benefit are different. Compare the applicable alternatives before requesting a change.
An investment rental or second home should not be budgeted as an approved permanent principal residence without confirmation. Recheck treatment after a change of owner, use, construction or property configuration.
Match DGI, ANATI and registry records
DGI directs owners to verify cadastral values with ANATI before checking the property-tax balance. Reconcile the finca identifier, owner, land and improvements against the deed and registry certificate. DGI property-tax guidance
Obtain a current account statement, receipts and required paz y salvo certificates. Identify arrears, interest, uncredited payments and pending valuation corrections before signing. Agree who pays each outstanding amount.
Confirm the current payment calendar, any advance-payment discount and whether a lender acts as a property-tax withholding agent. Keep mortgage payments, tax debits and PH fees as separate budget items.

Calculate the ordinary 2% transfer charge
The ordinary Impuesto de Transferencia de Bienes Inmuebles is 2%. Form 106 compares the sale price with the applicable updated cadastral amount, using the higher ordinary base. The form includes specific valuation adjustments; do not substitute an online estimate for the filed calculation. DGI Form 106 instructions
The transfer charge is separate from the capital-gains advance. Seller filing obligations and the contract’s allocation of closing costs are different issues. Require a settlement statement identifying the taxpayer, calculation, payment and any reimbursement.
First-sale projects, special taxpayer categories, exemptions and non-sale transfers require their own review. Ask counsel to confirm the applicable regime rather than applying a universal 5% closing-tax assumption.
Transfer declaration
Reconcile Form 106 with the deed, cadastral records and approved payment. Check any adjustment or exemption.
Sale-tax advance
Review Form 107 separately. A 3% advance on value is different from 10% of a taxable gain.
Registration costs
Obtain itemized notary, registry, search, legal and financing estimates in addition to the tax declarations.
Separate the 3% advance from tax on the gain
For an ordinary non-business disposal, Form 107 uses an advance of 3% of the higher sale or cadastral value. The normal capital-gains calculation is 10% of the taxable gain. DGI’s form also provides an election to treat the 3% as definitive. DGI Form 107 guidance
Have an accountant determine the permitted tax basis, documented improvements, disposal expenses and any claim for excess advance. Do not simply add 3% and 10% as two final taxes on the same sale.
Developer first sales, business disposals and certain agricultural or rural property use special rules. Identify the transaction category before estimating seller proceeds. Preserve acquisition records, expense evidence and the filed tax reconciliation.
Budget income tax from the taxable net amount
DGI’s general individual schedule is 0% through B/.11,000 of annual net taxable income; 15% on the excess through B/.50,000; then B/.5,850 plus 25% of the excess above B/.50,000. The general corporate rate is 25% of net taxable income. DGI income-tax rates
Panama-source rent needs a local tax review even when the owner lives elsewhere. Confirm deductions, taxpayer classification, other taxable income, registration, invoices, filings and any nonresident withholding before using the individual bands.
Illustration only: an individual with B/.25,000 total annual net taxable income under the general schedule pays B/.2,100: (B/.25,000 − B/.11,000) × 15%. This is not a flat 15% tax on every rent receipt. Keep the taxable calculation separate from cash operating costs.
Check lease duration and operating permission
DGI describes an ITBMS exemption for a lease exclusively used as the tenant’s home when its term exceeds six months. Shorter leases are treated differently; PH reporting duties can also apply. Confirm the treatment of a six-month term and all registration or collection obligations. DGI residential-lease exemption
An ITBMS rule does not authorize tourist accommodation. Check municipal zoning, the PH rules, tourism registration and any restrictions on short stays before listing on a platform. Obtain a written operating review for the specific address.
For commercial leasing, furnished stays or hospitality services, ask an accountant about ITBMS classification, invoicing and thresholds. Platform collection and management contracts do not prove that every liability or licence has been satisfied.
Read the PH budget before buying an apartment
Law 284 of 2022 governs Panama’s Régimen de Propiedad Horizontal. Review the registered copropiedad rules, ownership share, monthly common-expense quota, arrears and extraordinary assessments. Official PH law
Ask for approved budgets, recent assembly minutes, insurance, reserve funding and engineering reports. Identify elevator, façade, roof, water-system and security costs. A low current fee can coexist with substantial unfunded work.
Check rental restrictions, guest access, parking and storage rights, pet rules and permitted alterations. Request the administrator’s clearance and a written allocation of any pending assessment. Common-expense quotas are ownership costs separate from DGI taxes.

Confirm the finca and seller’s authority
Obtain current Public Registry certification and an independent review of title, mortgages, liens, restrictions and signing authority. Match the registered unit and any accessory parking or storage to the contract. Public Registry of Panama
Investigate whether coastal or rural property is titled land, possessory rights, a concession or another interest. Verify boundaries, legal access, permitted use and environmental or heritage restrictions. Possession and a tax account are not substitutes for registrable title.
Use a documented closing sequence with independently verified payment instructions, executed deed, discharge of liens, registry filing and updated evidence. Agree how requisitions, escrow releases and delivery of possession will be handled.
Apply the September 2026 investment categories
Decree 17 of 8 September 2026 sets B/.300,000 for eligible new first-sale property and B/.500,000 for secondary-market property under the Qualified Investor route. New, unoccupied status and prior sale or occupation matter. Decree 17 — current residency framework
The decree requires traceable qualifying foreign-source funds, evidence of ownership or beneficial ownership, and other migration documents. The investment must be maintained for at least five years, with annual verification. A purchase price alone does not establish eligibility.
Have immigration counsel confirm the subcategory before a deposit, including entity ownership, financing, valuation, preconstruction guarantees, fees and any transitional rule. Buying property does not automatically confer residence, a work permit or a tax exemption.
Choose the route separately from the property
Pensionado, nationality-based and other residence categories have different eligibility and evidence requirements. Consult the current Servicio Nacional de Migración procedures before choosing a property or entity for an application. Official migration authority
Residency incentives should be compared with legal fees, application charges, dependants’ costs and continuing conditions. Keep a purchase budget independent of expected approval; do not assume a programme name guarantees a particular outcome.
Tourism incentives require their own eligible project and approval. An apartment marketed for holiday rental does not automatically qualify for tax relief. ATP tourism-incentive procedures
Separate immigration status from tax compliance
Determine the owner’s tax residence and Panama-source income obligations separately from immigration residence. Ask about applicable remittance withholding, treaty treatment and home-country reporting. Obtain actual payment evidence for any credit claimed abroad.
Compare personal and entity ownership before signing. Include accounting, registered-agent costs, annual charges, beneficial-owner records, distributions and the eventual sale. A company structure should have a documented purpose and complete compliance records.
Keep taxpayer identifiers, authorized representatives and account contacts current. A local property manager collecting rent does not replace the owner’s filing responsibilities. Have the accountant document which returns and payments each party handles.
Model purchase, annual costs and the sale
Acquisition budget: price + allocated transfer charges + notary and registry costs + independent advice + financing and bank charges + corrective work + contingency. Record seller taxes separately rather than assuming the buyer bears every charge.
Annual budget: property tax + PH quotas and assessments + rental taxes + management + insurance + maintenance + utilities + vacancy and capital repairs. Include any residency-compliance expense as its own line.
Illustration only: at B/.300,000 cadastral value, approved home status produces B/.900 annually under the preferential schedule; the general schedule produces B/.1,720 before special exemptions or adjustments. Obtain the actual assessment. A PH land-only rule can change this comparison.

Keep clear authority and a reliable audit trail
Set written collection authority, spending limits, monthly reporting and an emergency process. Reconcile rent invoices, bank receipts, tenant deposits, tax records and PH statements. Separate client funds from operating expenses.
For a power of attorney, obtain advice on scope, authentication and acceptance by the notary, registry and bank. Grant sale or mortgage powers only when intended. Preserve signed leases, certified deeds and exemption decisions securely.
Review insurance, disaster exposure, vacancy, reserve funding and succession arrangements. If residency depends on the investment, obtain advice before selling, refinancing or changing the ownership structure. Schedule annual compliance checks well before deadlines.
Four checkpoints for Panama property
Before an offer
Review title, cadastral classification, exemptions, PH rules and intended use. Confirm residency eligibility independently of the listing description.
Before completion
Approve Forms 106 and 107 where applicable, clear arrears, itemize closing costs and agree the deed, payment and registration process.
Before renting
Confirm rental-income treatment, ITBMS, taxpayer registration, licences and building restrictions before advertising or collecting deposits.
Before a sale
Prepare the gain and advance-tax calculations, documents for any refund, lien discharges and PH clearance. Check any residency-maintenance condition.

Compare other property tax guides
Comparing countries can help you identify questions to ask about annual property tax, purchase charges, rental income and capital gains. The guides below cover different tax systems; compare their categories and verification steps before comparing headline rates.
Build a separate worksheet for each proposed property. Note the municipality, registered owner, intended use, acquisition date and currency. Beside every amount, record whether it is an official assessment, a professional estimate or an item still awaiting confirmation. A quoted purchase price alone does not establish the taxable value or the complete cost of ownership.
When comparing a property in Panama with one elsewhere, separate recurring taxes from one-time transaction charges and private operating costs. Confirm who pays each amount, when it falls due and which document proves payment. Keep exemption applications, tax receipts and title records in the same property file so your advisers can trace the assumptions behind the budget.
